THESE TERMS OF USE ARE SUBJECT TO CHANGE BY THE COMPANY AT ANY TIME IN ITS DISCRETION. Membership Cancellation and Refund Policy

The NCDA & The Drafting Directory have a No Refund Policy. Membership dues are Non-Refundable.

Upon cancellation of your membership, your account will be closed immediately and your profile, including all contents, will be deleted from our servers within 30 days of your cancellation. Should our staff determine your profile inappropriate for any reason, including Terms of Service violations, we reserve the right to close your account for investigation and possible cancellation. We reserve the right to determine if a refund is appropriate on a per case basis.

By making a payment for Membership to our site, you acknowledge that you have read and agree to the above No Refund Policy.

Search

This website is an online "directory" and should only be considered and used as such. Though you may be contacted for employment by someone browsing the database, this is not an employment site, but a directory from which you may or may not be found and/or contacted for employment of any kind. The NCDA does not provide employment in any way. The Company and their associates are not liable, in any way whatsoever, for personal or business relationships and/or transactions as a result of this website. It is the sole responsibility of the user to do their due diligence when working with members of this website. You may or may not receive employment as a result of having a listing with this website or membership with the association.

Reporting Members

The Company and their associates do not police the actions of it's members outside of this website. Should a member be reported for any reason, we reserve the right to investigate and take action deemed appropriate by us. Reporting members should be confined to materials and/or information presented on this website. The Company is not involved in the financial transactions between members and others. It is not possible for The Company to enforce member behavior outside of this website. Accordingly, you are ultimately responsible for the member relationship(s) you engage in. Members are advised to do the same due diligence when working with the public.

Spamming and/or Harrassment

This category includes:

Excessively communicating/messaging the same phrase, similar phrases, or pure gibberish.
Communicating with other members for the sole purpose of causing unrest.
Causing disturbances such as picking fights, making off topic messages, and insulting other members.
Sending non-constructive messages to other members.
Spamming the same message repeatedly to other members.
Excessively contacting "Member Support" for non-issues, issues deemed resolved by Support, and the like whether "in-reply" or as part of a new message.
Abusing the "Report" feature by sending false alarms or nonsensical messages to Support.

Although under no obligation to do so, The Company reserves the right to monitor use of this site to determine compliance with these Terms of Use, as well the right to remove or refuse any information for any reason. Notwithstanding these rights, you remain solely responsible for the content of your submissions. You acknowledge and agree that neither The Company nor any third party that provides Content to The Company will assume or have any liability for any action or inaction by The Company or such third party with respect to any submission.

Security

Any passwords used for this site are for individual use only. You will be responsible for the security of your password (if any). The Company will be entitled to monitor your password and, at its discretion, require you to change it. If you use a password that The Company considers insecure, The Company will be entitled to require the password to be changed and/or terminate your account.

BY ACCEPTING THIS AGREEMENT YOU WAIVE AND HOLD HARMLESS THE COMPANY FROM ANY CLAIMS RESULTING FROM ANY ACTION TAKEN BY COMPANY DURING OR AS A RESULT OF ITS INVESTIGATIONS AND/OR FROM ANY ACTIONS TAKEN AS A CONSEQUENCE OF INVESTIGATIONS BY EITHER THE COMPANY OR LAW ENFORCEMENT AUTHORITIES.

Important Notice:

These Terms of Use will be governed and interpreted pursuant to the laws of Georgia, United States of America, notwithstanding any principles of conflicts of law. You specifically consent to personal jurisdiction in Georgia in connection with any dispute between you and Company arising out of these Terms of Use or pertaining to the subject matter hereof. The parties to these Terms of Use each agree that the exclusive venue for any dispute between the parties arising out of these Terms of Use or pertaining to the subject matter of these Terms of Use will be in the state and federal courts in Cherokee County, Georgia. If any part of these Terms of Use is unlawful, void or unenforceable, that part will be deemed sevarable and will not affect the validity and enforceability of any remaining provisions. These Terms of Use constitute the entire agreement among the parties relating to this subject matter. Notwithstanding the foregoing, any additional terms and conditions on this site will govern the items to which they pertain. Company may revise these Terms of Use at any time by updating this posting.
